Nebraska and Oklahoma are asking the U.S. Supreme Court to declare Colorado's legalization of marijuana unconstitutional. Nebraska Attorney General Jon Bruning has announced that the states are seeking a court order to prevent Colorado from enforcing a measure that was approved by voters in 2012. Bruning says Oklahoma Attorney General Scott Pruitt is also a party to the lawsuit. The complaint alleges that Colorado's Amendment 64 runs afoul of federal law. Bruning adds Colorado's move has increased the trafficking of marijuana in Nebraska and other neighboring states, placing unnecessary burdens on the states.
The chairman of the legislative committee that investigated the prison sentence miscalculation scandal objects to Gov. Dave Heineman's dismissal of the report as "a partisan shot." Sen. Steve Lathrop points out the committee was comprised of three Democrats, three Republicans, and one independent who unanimously concluded Heineman set the tone that led to the sentence miscalculations as the administration sought to avoid building a new prison. Lathrop says lawmakers never considered adding prison beds, because former state Corrections Director Bob Houston kept assuring them the prison population was manageable.
A legislative investigation into prison sentence miscalculations and another into how best to reduce the growing prison population will most likely spur proposals to spend more on Corrections during the new legislative session. Appropriations Committee chairman, Sen. Heath Mello of Omaha, says the Council of State Governments has been meeting with lawmakers on prison reform. The CSG plan proposes spending $33 million over the next five years to reduce the prison population by 10 percent. Mello says other requests will include more money for additional mental health treatment programs as well as job training programs designed to help inmates adjust once freed from prison.
A Columbus man has pleaded guilty to exposing himself to two 17-year-old girls at a city library. Twenty-two-year-old Mitchell Ryan has admitted to two counts of public indecency. Prosecutors dropped a charge of obstructing a police officer in the plea deal. Police were called to the library on Oct. 27 by the high school students. The arresting officer says Ryan pulled away from him and fled on foot during the arrest. He was later found hiding in a dumpster. Ryan faces up to a year in jail when he is sentenced in January.
